SIGNIFICANT PROJECTS WITHIN THE LAST TEN YEARS

Union Station Revitalization Project - $715.4M component of a $1.6B project (TI/ICI Sectors):

Project Neutral for the resolution of ongoing disputes associated with matters arising out of the restoration/revitalization of Toronto’s Union Station. The project included: upgrading VIA Rail’s active platforms required to remain fully operational during construction; the quasi-mining activities under active rail tracks and platforms; the inserting a shopping plaza under active tracks; extending Toronto’s Path System; upgrading and renovating TTC’s Union Station subway station; integrating new and extended Metrolinx ‘Go’ regional transit system; extending infrastructure to support the new Pearson Airport light rapid transit spur; and the restoration of general heritage offices and infrastructure, as well as other renovations and upgrades to the entire complex. There were four formal and several informal hearings - all parties accepted my findings without question.

Union Station Revitalization Project
Vaughan Terminus Subway Station - $211.5M component of a $3.18B project (TI Sector):

Chaired three-person Dispute Resolution Board for the cut ‘n cover subway station and infrastructure component of the Toronto York Spadina Subway Extension (TYSSE) at the Vaughan Terminus subway station. The Board’s work involved the conducting of periodic visits to the site while the project is under construction (in order to remain current with the ongoing progress of the works), conducting review meetings on a regular bimonthly basis, delivering formal and informal recommendations on an ongoing basis, conducting formal hearings into disputes and delivering findings and recommendations for their resolution. During the course of the Board’s work there were 5 formal and 1 informal hearings.

Vaughan Terminus Subway Station
Finch West Subway Station ($127.5M component of a $3.18B project) (TI Sector):

Member of a three-person Dispute Resolution Board for the cut ‘n cover subway station and infrastructure component of the TYSSE at the Finch West subway station. The Board’s work involved the conducting of periodic visits to the site while the project was under construction (in order to remain current with the ongoing progress of the works), the conducting of review meetings on a regular trimester basis, the delivering of formal and informal recommendations on an ongoing basis, the conducting of formal hearings into disputes and delivering findings and recommendations for their resolution.

Due to the absence of any dispute activity the Board was asked to stand down in June 2015.

Finch West Subway Station
Historic Restoration, Library of Parliament, Ottawa - \$136M CAD (ICI Sector):

Provide Third Party Expert Determination services concerning issues arising between Public Works and Government Services Canada (PWGSC) the Contractor and its various Trade Subcontractors over changes in the work and the entitlement thereof. (entitlement only – not quantum)

Matters at issue included:
  • Heritage restoration of leaded stained glass windows
  • Historic stonework restoration
  • Heritage replacement of roofing systems
  • Heritage replacement and structural adaptation of original decorative wood framed library shelving

Many issues arose out of the restoration of historical components and artifacts. The Construction Industry at large no longer possesses the necessary skills of the original artisans and craftsmen who built the original structure.

The fact that this structure was also circular/conical in shape further complicated the ability of the trades to meet the exacting demands and original craftsmanlike tolerances demanded by the specifications.

My determinations were conducted in a manner that was interrogatory in nature with full and free independent access to both individual party’s files, ex-parte discussions and caucussing, fact finding, and collective interim joint reviews prior to preparation of my final written determinations

Historic Restoration, Library of Parliament
Replacement of curtain wall façade, Bank of Canada Building, Wellington Street, Ottawa, Canada - \$15M (CAD) (ICI Sector):

Prepare specialized Front-End consultation services to the Bank of Canada including the preparation of R&D/Design-Build/Clean/5-year Maintenance contract documentation; prequalification of bidders; bidding, preparation of Procurement and Front-End documentation; provision of bidding and bid evaluation assistance and support services; and the provision of Independent Third-Party Payment Evaluation and Certification Services throughout construction.

The Bank's heritage façade design was prematurely ageing and dilapidating due to the impact of acid rain on the electolytically incompatible copper/aluminum materials employed in the original design and construction of its curtain wall system. Since this was an award- winning design by Arthur Erickson, it was imperative that the building be restored to its original appearance with all of the technical problems attended to in an effective manner while, at the same time, maintaining full and undisturbed occupancy by their tenant (The Department of Justice) throughout the construction phase.

To achieve this goal 14 custom pulltrusion dies were designed and developed to resolve the rain-screen, stack-effect, ‘v’ shaped cladding support and metallic incompatibility problems, and new pressure bar pulltrusions were manufactured. The occupied building was progressively stripped of its façade and simultaneously replaced with these new window glazing and cladding systems - all manufactured to precise hairline three-dimensional coordinates to accommodate the exacting requirements of the original intercepting angular plane.

Bank of Canada Building
Integrated Building Trades College Facility and Light Rapid Transit Terminal (Cut ‘n Cover), Ottawa, Canada - \$94.5M (CAD): (ICI/HC/TI Sectors):

Provide expert Contractual Advisory Services with regard to specialized contractual procurement provisions.

Prepare custom Design-Build Procurement and Front-End Documentation; Mid-stream HST conversion Consultation Services; Provision of proposal evaluation assistance and proposal related counselling and support services.

Mr Davies crafted a ‘Fixed Price ($94.5M) Best Offer Design-Build contract incorporating a cash allowance (\$45.0M) for the LRT component of the work employing a CCDC 18 Unit Price trade contract to be performed by a pre-qualified (City list) sub-contractor.

The Project was a shared venture contract between the City of Ottawa and Algonquin College managed by Algonquin (MHPM) and was constructed by EllisDon.

Integration Building Trades College
Institutional Building, Rome, Italy - €5M (Euros): (ICI Sector):

Preparation of Design-Build/ Turnkey, Prequalification, Procurement and Front-End Documentation employing FIDIC Orange Book form of contract

Provision of proposal related counselling and support services during the procurement phase; and the Establishment of Dispute Adjudication Board (DAB) rules and services to be employed during the construction phase.

Provision of proposal evaluation assistance services.

Institutional Building, Rome, Italy

Morguard Investments Limited (ICI Sector):

The provision of Ongoing Specialist Consultant services with regard to establishing, implementing, applying and recording building standard and custom tenant area leasing measurements to BOMA standards for their various properties in the Ottawa Region as well as providing, from time-to-time, trouble-shooting services for their various ongoing projects in distress
